Terms of Service

These Terms of Service ("Terms") govern your use of the GLP-1 Companion mobile app and related services (the "App"), provided by Foldbay Technologies FZE LLC ("Foldbay", "we", "us", "our"), a company registered in the Ajman NuVentures Centre Free Zone, United Arab Emirates.

By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Important medical disclaimer: please read

GLP-1 Companion is a wellness and education tool. It is NOT a medical device, does NOT give medical advice, diagnosis or treatment, and does NOT replace your doctor.

• Talk to your doctor or another qualified healthcare professional before any decision about your medication, dose, diet or health.
• Never start, stop or change a medication or dose because of the App.
• Insights, trends, food checks, lab reads and other content, including AI-generated content, can be incomplete or wrong. Do not rely on them as medical guidance.
• If you have, or have had, an eating disorder, use the App only with your doctor's guidance.
• Using the App does not create a doctor–patient relationship.
• In a medical emergency, call your local emergency number immediately.

You decide how to use the information in the App, and you do so at your own risk.

2. Who can use the App

You must be 18 or older and able to enter into a binding agreement. By using the App you confirm that you are.

3. Your account

Give accurate information, keep your password private, and tell us promptly if you think someone else has used your account. You are responsible for activity under your account. One account per person.

4. Free access, trial and subscriptions

• Free: dose and weight tracking stay free.
• Free trial: new accounts can start a 7-day free trial of Pro in the App. No payment details are needed, and it ends automatically. One trial per person.
• Pro subscription: monthly or yearly, bought through the Apple App Store or Google Play. The price and the billing period are shown in the App before you buy, in your local currency.
• Automatic renewal: your subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Your store account is charged within 24 hours before renewal.
• Cancelling: manage or cancel anytime in your App Store or Google Play account settings. You keep Pro until the end of the period you paid for. Deleting the App or your account does not cancel a store subscription.
• Refunds are handled by Apple or Google under their policies; we cannot issue store refunds ourselves. Nothing in these Terms limits refund rights you have under the consumer law of your country.
• Promo codes give the access, and for the period, stated with the code. They have no cash value, cannot be resold, may expire, and can be used once per account.
• Price changes apply only to future billing periods, after the notice the stores and the law require.

5. Fair use

AI features have reasonable daily limits so the service stays fast and affordable for everyone. You agree not to use the App for any unlawful purpose; copy, reverse-engineer or extract its source code (except where the law allows); disrupt or overload the service; access it by automated means without our permission; or misuse anyone else's data.

6. Your data

Your data stays yours. You allow us to store and process it only to run the App and provide its features to you, including sending content to our AI provider as described in the Privacy Policy. We do not sell your data or use your health data to train AI models. You can delete your account and data in the App at any time.

7. Our intellectual property

The App, its design, content and software (but not your data) belong to Foldbay. We give you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial use, in line with these Terms and the app store's rules.

8. Disclaimers

The App is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free, or that any information in it (including AI-generated content) is accurate, complete or right for your situation. See Section 1.

9. Limitation of liability

To the extent the law allows, Foldbay and its owners, staff and providers are not liable for indirect, incidental, special, consequential or punitive damages, or for any health outcome, loss or harm from using or relying on the App. Where liability cannot be excluded, our total liability is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot legally be limited, such as for death or personal injury caused by negligence, fraud, or your mandatory consumer rights.

10. Indemnity

You agree to cover Foldbay's reasonable losses and costs from claims caused by your misuse of the App or your breach of these Terms.

11. Ending your use

You can stop using the App and delete your account at any time. We may suspend or close an account that breaks these Terms, or where needed to protect the service or follow the law. We may change or stop features; if we stop the App entirely, we will give reasonable notice. Sections that by their nature should continue (for example 1, 8, 9 and 12) survive.

12. Governing law

These Terms are governed by the laws of the United Arab Emirates. Disputes go to the competent courts of the UAE, unless the mandatory consumer law of your country gives you the right to bring a claim where you live.

13. App store terms

If you downloaded the App from the Apple App Store: these Terms are between you and Foldbay, not Apple. Apple has no obligation to provide maintenance or support for the App. If the App fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation. Foldbay, not Apple, is responsible for handling claims about the App (including product liability, legal or regulatory compliance, consumer protection, and intellectual-property claims). You confirm you are not in a country under a US government embargo or on a US prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded the App from Google Play, Google Play's terms also apply to your purchase.

14. Changes to these Terms

If we change these Terms in a material way, we will tell you in the App or by email before the change takes effect, and update the date above. If you keep using the App after that, the new Terms apply.
